This Privacy Policy (“Policy”) describes how the 12th Man Foundation (“12th Man Foundation,” “we,” “us,” or “our”) collects, uses, discloses and otherwise processes personal information in connection with our websites, including www.12thmanfoundation.com, and other online services that link to this Policy (collectively, the "Site"), as well as our interactions with donors, members, ticket purchasers, event attendees and other supporters. The 12th Man Foundation is committed to respecting your privacy rights.

For purposes of the Privacy Policy, “Personal Information” means information that identifies, relates to, describes or is reasonably capable of being associated or linked with an individual, household or device, as defined by applicable law.

We may update this Policy from time to time to reflect changes in our practices, technologies or legal requirements. When we make changes, we will post the updated Policy and revise the “Last Updated” date above. Where required by applicable law, we will provide additional notice or obtain consent before using Personal Information for a materially different purpose.

By accessing, visiting or using our Services, you agree to our Terms and Conditions, and you acknowledge that we collect and use your Personal Information in accordance with this Policy.   • Account, membership and affiliation information, such as account identifiers, login information, membership status, donor status, Texas A&M affiliation information, preferences and related account information.
  • Ticketing, transaction and donation information, such as tickets purchased, transferred or used, ticket and event information, donation and giving history, membership transactions, priority point information and other transaction details.
  • Payment-related information, such as billing and transaction information collected and processed directly by our payment processors and other service providers.
  • Internet and electronic activity information, such as IP addresses, device and browser information, cookie or similar identifiers, pages viewed, links clicked, referring URLs and interactions with the Site and our communications.
  • Communications and preferences, such as inquiries, correspondence, marketing preferences and other information you provide when communicating with us.
  • Other information you provide to us or that we receive from third parties, including information from service providers, event and ticketing partners, Texas A&M University, public sources and other partners or data providers.

II. HOW WE COLLECT PERSONAL INFORMATION

We collect your personal data from a variety of sources, including directly from you, automatically when you interact with our Services, and from third parties, as described below:

  • When you provide it directly. We collect Personal Information directly from you when you: register for an online account with us; sign up for updates and marketing communications from us; participate in our surveys, programs or events; contact us for customer service; communicate with us on social media; or otherwise interact with us via our online services. We also collect Personal Information directly from you when you contact us on behalf of a current, former or prospective service provider, vendor or other business partner.
  • When we collect it automatically. We automatically collect your Personal Information when you use our online services. For example, we may collect information from or about the computer, phone or other device from which you access our online services and information about your usage of our online services.   • When we receive it from third parties. We may receive Personal Information about you from third parties, such as companies with whom we run events, organizations we work with, publicly available sources or information which is published in the media.

III. COOKIES AND OTHER TRACKING TECHNOLOGIES

We and our service providers and other third parties may use cookies, pixels, tags, web beacons, analytics technologies, advertising technologies and similar tools (collectively “Tracking Technologies”) on the Site. These Tracking Technologies may collect information such as your IP address, device and browser information, unique identifiers, pages viewed, links clicked, referring URLs and other information about your interactions with the Site.

Why Does the Site Use Tracking Technologies?

We use these Tracking Technologies to operate and secure the Site, remember preferences, understand how the Site is used, measure the effectiveness of our communications and advertising, support our marketing and advertising activities and further personalize your experience when you are visiting the Site. By tracking usage, we can determine what features of the Site best serve the users.

Managing Tracking Technologies

Where required by applicable law, you may manage certain Tracking Technologies sent by the Site by selecting an option on your browser to reject tracking through cookies, however, some tracking technologies, such as essential cookies, are necessary to operate the Site. Opting out of certain cookies may affect your experience on the Site.

Our Site does not respond to “Do Not Track” signals.

Other sites linked to the Site may also send cookies; however, we do not control such activities.

We take reasonable steps to limit access to your Personal Information to our employees, agents, contractors, and other parties to the extent necessary for the purposes set out in this Policy. Where required, we provide you with the ability to opt out of these disclosures or first obtain your consent. We may disclose your Personal Information as described in the categories under Section I, in the following ways:

  • With Our Affiliates and Related Organizations. We may disclose some or all of your Personal Information with affiliated or related organizations for the purposes described in this Privacy Policy unless otherwise prohibited by applicable law or by contractual agreement with our vendors, service providers or other third parties.
  • To Service Providers. We may disclose Personal Information to vendors, service providers, contractors, professional advisors and other entities that need this information to provide services to us, such as: hosting the Site; designing and/or operating the Site's features; tracking the Site's activities and analytics; enabling us to perform administrative services; and operating our customer service. These service providers may have access to or process your Personal Information only for the purpose of providing services to us.
  • Business Partners, Sponsors and Other Third Parties. We may disclose your Personal Information to business partners, co-sponsors of promotions and other third parties in order to provide you with services that may interest you. For example, we may co-sponsor promotions or other events with a third party and may share your Personal Information in connection with these events. If you provide additional information to any of these third parties, such information provided to these third parties will be subject to each third party's privacy practices and policies.
  • Analytics and Interest-based Advertising Partners. We use third-party analytics, advertising and marketing providers to collect information about your use of the Site, see the overall patterns of usage on the Site, deliver advertisements, optimize ad performance and determine whether our advertising is effective. Where permitted by applicable law, we may share your Personal Information with marketing and advertising partners for targeted advertising purposes, so that we can better understand which of our services may be of interest to you, market our services to you and to provide us information necessary to improve our services.
  • As Necessary to Comply with Our Legal Obligations. We may also disclose Personal Information in order to assist with or otherwise enable our compliance with a legal or regulatory obligation, protect and defend our rights or property, protect the safety of our users or the public and to establish or defend our legal rights.
  • As Part of an Organizational Transaction. We may disclose Personal Information in connection with a merger, reorganization, affiliation, transfer of assets, or similar organizational transaction. If we engage in such a transaction, we will make reasonable efforts to direct the recipient to use your Personal Information in a manner that is consistent with this Policy. After such a transaction, you may contact the recipient with any inquiries concerning the recipient's privacy practices.
  • With Outside Professional Advisors. We may share or disclose your Personal Information with any of our professional advisors such as attorneys or accountants (“Outside Professionals”) to facilitate the professional advice from those Outside Professionals.

In addition, we reserve the right to share ticket buyer data with the NCAA and College Football Playoff (CFP) for Texas A&M University-hosted postseason athletic events, and with event promoters, organizers, agents and other applicable parties for third-party events hosted by the University.

VI. THIRD-PARTY SITES AND SERVICES

Third-party sites linked to and from the Site are not necessarily under our control. We shall have no responsibilities or liabilities whatsoever for the content or privacy practices of any such linked site or any link or linking program at any time. We do not necessarily endorse companies (or related products or services) to or from which the Site is linked. If you decide to access any of the third-party sites linked to the Site, you do so entirely at your own risk. The 12th Man Foundation hereby disclaims any rights to trademarks, service marks, trade names, logos, copyrights, patents, domain names or other intellectual property interests of third parties.

VII. CHILDREN'S PRIVACY

We care about the safety of children and their use of the Internet. Therefore, we will never knowingly request or solicit personally identifiable information from anyone under the age of 13 without verifiable parental consent. In the event that we learn that we have collected such Personal Information without the requisite and verifiable parental consent, we will delete that information from our database as quickly as is practical. If you believe that a child has provided Personal Information to us in violation of applicable law, please contact us using the information provided below.

VIII. YOUR PRIVACY RIGHTS AND CHOICES

The 12th Man Foundation is a Texas nonprofit organization. As such, we are exempt from the Texas Data Privacy and Security Act (TDPSA). We may also be exempt from other states' applicable data privacy laws. Despite this exemption status, upon receiving a written request for data deletion from our systems, we will make reasonable efforts to delete personal contact information while retaining transactional accounts and records required for financial audits.

Depending on your state of residence and applicable law, you may have certain rights regarding your Personal Information. These may include the right to:

  • confirm whether we process your Personal Information and access or obtain a copy of that information;
  • correct inaccurate Personal Information;
  • request deletion of Personal Information;
  • obtain Personal Information in a portable format;
  • obtain information regarding third parties to which we have disclosed Personal Information, where applicable;
  • opt out of the sale of Personal Information, targeted advertising, or certain profiling;
  • withdraw consent where processing is based on consent;
  • appeal a decision we make regarding a privacy rights request; and
  • exercise your privacy rights without unlawful discrimination.

To submit a privacy rights request, please email privacy@12thmanfoundation.com with “Privacy Request” in the subject line, and describe the request you would like to make. We may take reasonable steps to verify your identity before processing a request. Where permitted by applicable law, you may also use an authorized agent to submit a request on your behalf.

If your request is denied and applicable law provides a right to appeal, you may submit an appeal by emailing the same address with “Privacy Appeal” in the subject line.

To manage certain cookies and tracking technologies, please use the privacy or cookie controls provided on your applicable browser.

You may opt out of marketing emails at any time by using the unsubscribe or email-preference link contained in those communications. Even if you opt out of marketing communications, we may continue to send transactional or service-related communications where appropriate.

IX. PAYMENTS AND TICKETING SERVICES

The 12th Man Foundation utilizes third-party services to support ticketing and payment processing. Our ticketing, account, donation and related services may be hosted or supported by Paciolan, and payment transactions may be processed by providers such as Stripe, FEVO, Cybersource and other payment processors.

We generally do not store or collect full payment card details. Any payment information is provided directly to our payment processors and is governed by their Privacy Policy. We may receive transaction, billing, fraud-prevention or payment-confirmation information necessary to administer the transaction and our relationship with you.

X. SECURITY

Security and privacy of your personal information is important to the 12th Man Foundation and its contracted third-party organizations. We maintain reasonable administrative, technical and physical safeguards designed to protect Personal Information against unauthorized access, use, disclosure, alteration or destruction. We also require service providers that process Personal Information on our behalf to protect that information consistent with applicable legal and contractual requirements. While we take every reasonable step to ensure the security and privacy of your information, no system can offer absolute guarantees as no method of transmission or storage is completely secure, and we therefore cannot guarantee absolute security. We remain dedicated to minimizing risks to ensure security, integrity and the privacy of your information.
